Dr. Fabienne Diekmann
Dr. Fabienne Diekmann has been a member of the firm since 2006. Her clients primarily include companies from the pharmaceutical and food industries. She advises and supports these clients from obtaining manufacturing authorisation, through product development to distribution. She also assists pharmacists with matters concerning professional law and own brands and represents them in disputes with pharmacists' associations, supervisory authorities and health insurance funds.
Thanks to her many years of experience in the health sector, she has strong contacts with EU and German federal and regional authorities.
Dr. Diekmann gives presentations and writes about many different topics affecting the pharmaceutical industry. She is a member of the contract handbook working group of the B.A.H. (German association of pharmaceutical manufacturers), the board of editors of the magazine “Patienten- und PflegeRecht” (pmiVerlag) as well as the Pharma Licence Club Deutschland.

“This book constitutes a detailed dissertation on the concept of the consumer model - and not only in terms of health. First the differences in the consumer model in European and German jurisdiction are discussed, along with the development thereof. The influence of the relevant consumer model on court rulings is discussed using examples of resolutions made by the European Court of Justice and German Federal Court of Justice. Here it already becomes clear to the reader that there is not just one average consumer. This becomes even clearer in the subsequent presentation of different consumer models that are applied in the food, medicine and pesticide sectors. The book is not always entirely easy to read for those without legal expertise, but nevertheless opens up new insights into the basis for decisions made by the courts in the field of consumer protection. Perhaps it will also contribute towards forming an independent argument in terms of consumer protection in a more expedient manner.”
